MEDICATIONS/SUPPLEMENTS: If your dog is on medication and/or vitamin supplements, please bring more than enough of each for your dog’s entire stay. If the supply of medications or supplements you provided is exhausted during your dog’s stay, Elkhorn Dog Services LLC will make every effort to procure essential medications only, and you will be charged for the quantity purchased as well as a procurement fee including time at $25/hr and mileage. Elkhorn Dog Services LLC may be unable to obtain certain medications that require a veterinarian prescription. Charges may apply for the administration of medications and/or supplements.
PERSONAL ITEMS: Do not bring personal items for your dog(s) boarding. Elkhorn Dog Services LLC is not responsible for loss or damage to any personal item, including bedding or toys, left with or for your dog(s).
ABANDONED DOG POLICY: Unless otherwise required by applicable law, if you fail to pick up your dog(s) by the designated time and have failed to make satisfactory alternative arrangements, Elkhorn Dog Services LLC will continue to provide basic service to ensure the dog’s health and safety, and charges will continue to accrue. Elkhorn Dog Services LLC will make best efforts to contact you using the information you provided, advising you that if your dog(s) is not picked up within a reasonable time period, your dog(s) will be deemed to be abandoned and that Elkhorn Dog Services LLC will deliver the dog(s) to a third‐party adoption partner or to Woodford County Animal Control. You understand that you may lose ownership of your dog(s) under these circumstances. If you fail to pick up your dog(s) for any reason by the designated time, you release Elkhorn Dog Services LLC from all further liability and responsibility for your dog(s). You shall remain liable to Elkhorn Dog Services LLC for all unpaid charges, including without limitation the court costs and reasonable attorneys’ fees incurred in the collection of such charges.
***Representations and WAIVERS OF LIABILITY***
1. I represent and agree that I am the owner (or designated agent of the owner) of the dog(s) and am fully authorized to enter this agreement.
2. I represent that my dog(s) have had all required vaccinations, including but not limited to, vaccinations to protect against canine distemper virus, parvovirus and rabies. I agree that I will present proof of all vaccinations and the name, address and telephone
number for the veterinarian(s) who administered the vaccinations upon request of any Elkhorn Dog Services LLC employee.
3. I understand and agree that Elkhorn Dog Services LLC is relying on my representations of my dog’s (dogs’) health and behavior. I further understand and agree that Elkhorn Dog Services LLC and its staff will not be liable for any health problems that develop during or as a result of boarding. I agree and understand that Elkhorn Dog Services LLC reserves the right to deny admittance to my dog(s) at any time for any reason.
4. I understand and agree that if, during my dog’s (dogs’) boarding, my dog (dogs), without provocation, bites a person or other domestic animal, Elkhorn Dog Services LLC will make arrangements to have my dog transferred to Woodford County Animal Control. Elkhorn Dog Services LLC will call me immediately.
5. I represent and agree to hold Elkhorn Dog Services LLC harmless and indemnify Elkhorn Dog Services LLC against any and all liability claims, including any claims or lawsuits for bodily injury or damage to someone’s property if my dog (dogs) injures someone (including Elkhorn Dog Services LLC staff), injures another dog(dogs) or destroys property, including Elkhorn Dog Services LLC property.
6. I represent that I have liability insurance (homeowners, condominium or otherwise) and will present proof of said liability insurance prior to the start of boarding that shows I have insurance to cover any accidental or intentional injuries to person or property my dog (dogs) causes during boarding. I agree that my liability is primary for any accidental or intentional injuries my dog (dogs) causes during boarding.
7. I understand and agree that Elkhorn Dog Services LLC will not be liable for any injuries or illnesses that occur as a result of my dog’s(dogs’) attendance, provided that reasonable care and precautions are followed.
8. I understand that group exercise and group play are situations where dogs co‐mingle in groups, and if I have given permission to Elkhorn Dog Services LLC to allow my dog(s) to participate in any group activity, I understand and acknowledge that there are risks inherent when dogs co‐mingle, including, but not limited to, bites, scratches and sore muscles.
9. I understand that Elkhorn Dog Services LLC is not a veterinary establishment and does not practice veterinary medicine. I understand and agree that if my dog(s) become ill or injured, of if the state of the dog’s (dogs’) health requires medical attention, Elkhorn Dog Services LLC, in its sole discretion, may engage the services of a veterinarian or administer medicine or give other requisite attention to the dog. Elkhorn Dog Services LLC staff will make their best efforts to notify me in the event of a serious illness or injury using the contact information I have provided to Elkhorn Dog Services LLC. I understand that I am responsible for providing updated contact information. I agree to assume full financial responsibility for any and all expenses incurred, and I release Elkhorn Dog Services LLC and its staff from any and all responsibility for, or claims, damages, debts, arising out of or related to such medical care, including, but not limited to, transportation to/from the veterinary clinic and choice of veterinarian and animal hospital.
10. I certify, to the best of my knowledge, my dog (s) has not been exposed to any communicable diseases with the past 30 days. I agree that I will notify Elkhorn Dog Services LLC of any known exposure of my dog(s) to communicable diseases and will keep my dog(s) out of playcare and will provide a veterinary certification of fitness for playcare to be admitted or re‐ admitted. I also agree that I will maintain current vaccines for my dog(s) and provide certification to that effect upon initial evaluation and periodically as requested.
11. I understand and agree that I am solely responsible for any and all acts or behavior of my dog(s) while in the care of Elkhorn Dog Services LLC. I release Elkhorn Dog Services LLC from any liability arising from my dog’s (dogs’) attendance at Elkhorn Dog Services LLC and accept full responsibility for any and all costs for injury to staff or other animals or damage to facilities caused by my dog(s). I hereby release Elkhorn Dog Services LLC of any liability and I further agree to indemnify and save them harmless against any and all claims arising from my dog’s (dogs’) attendance at Elkhorn Dog Services LLC, including but not limited to all costs, damages, attorneys fees,
expenses and liabilities in connection therewith.
12. I understand that in an emergency event, such as a natural disaster, every effort will be made to contact me to retrieve my dog(s). I agree that Elkhorn Dog Services LLC. in its sole discretion, is authorized to transport and/or make temporary alternative arrangements to house and care for my dog(s) until I retrieve my dog(s).
13. I understand and agree that my dog(s) may be photographed, videotaped and/or recorded and that Elkhorn Dog Services LLC retains all rights to use, and proceeds from use of, images.
14. I understand that this agreement covers the current relationship between Elkhorn Dog Services LLC and me. Each time I bring my dog(s) to Elkhorn Dog Services LLC, I am affirming the terms of this Agreement and the truthfulness and accuracy of all statements I make in this Agreement.
I have read and understand this entire Agreement, I have had an opportunity to discuss it to my satisfaction with a representative of Elkhorn Dog Services LLC, and by typing my name below, I agree to its terms.
If, at the completion of the training the dog is not picked up by the owner and payment made of all charges, including applicable medical and veterinarian charges as provided herein, Danielle Doth and Elkhorn Dog Services LLC shall notify owner by certified mail at the address provided above that the dog will be held for an additional 10 days following the date of mailing of notice. At the end of said 10 day period, if the dog is not picked up by the owner and all charges paid in full (including additional boarding charges), then the owner agrees that Danielle Doth and Elkhorn Dog Services LLC may, at its option:
1. Sell the dog at public or private sale;
2. Return the dog to the owner;
3. Cause the dog to be euthanized, if, in the judgment of Danielle Doth and Elkhorn Dog Services LLC, the history of behavior of the dog does not make it suitable as a pet.
The proceeds of any sale shall first be applied to the charges of Danielle Doth and Elkhorn Dog Services LLC, and the balance, if any, shall be returned to the owner's address as shown above.
Owner understands that participating in training does not guarantee the performance or behavior of their dog(s). Information and instruction is provided strictly as guidelines and Danielle Doth and Elkhorn Dog Services LLC cannot predict the behavior or obedience of their dog in the future.
Owner represents that owner is the legal owner of the dog; that the dog is free and clear of any encumbrance; that the dog had not been exposed to distemper, rabies or parvovirus within that past thirty (30) days; that the dog has been inoculated as disclosed in the intake form; is free of worms, heartworm, and fleas; that the dog is currently and properly licensed; and that owner has read this agreement in its entirety.
I hereby agree to indemnify and hold harmless Danielle Doth and Elkhorn Dog Services LLC from any claims, liability, suits, or any other actions resulting from any damages, losses, injuries or death caused by (1) the services being provided under the terms of this Agreement including, but not limited to, the involvement of the undersigned owners or owner's dog in the activities or services provided under this Agreement, and (2) the actions of another dog owner or his dog. Should it be necessary for Danielle Doth and Elkhorn Dog Services LLC. to enforce the terms of this Agreement, I shall be responsible for all of the fees and costs relating to such enforcement, including, but not limited to, any attorney fees incurred by Danielle Doth and Elkhorn Dog Services LLC. This document shall be governed by and construed in accordance with the laws of the State of Kentucky and I agree that the Kentucky District Court for Woodford County shall have exclusive jurisdiction regarding any claim arising out of this document or any other action which I may have against Danielle Doth and Elkhorn Dog Services LLC.
This agreement is made on the date set forth below between Danielle Doth and Elkhorn Dog Services LLC and the undersigned owner(s), for provision of the services set forth herein, and subject to the terms set forth in this agreement.
By typing my name below, I agree that I have read this agreement in full, and agree to the terms set forth.
